A seguire
- il requisito degli effetti sugli scambi tra Stati membri, in relazione alla nozione di aiuto di Stato, ai sensi dell’art. 107 TFUE, collocato nella diversa funzione di controllo svolta dal giudice interno sulle misure nazionali, rispetto a quella del giudice UE sulle decisioni della Commissione
- la gestione, a livello nazionale, degli ordini di recupero relativi a regimi di aiuti e la relativa tutela giurisdizionale (anche in correlazione con il profilo summenzionato)
- il profilo dell’affidamento legittimo, oltre la giurisprudenza relativa alla validità dell’ordine di recupero, ed in particolare nell’ottica di un’eventuale responsabilità degli organi interni
